Terms of Service

1. Eligibility

You may use the Service only if you are at least 13 years old and are not barred from using the Service under applicable law. If you are under 18, you must have your parent or guardian's consent. By using the Service, you represent that you meet these requirements.

2. Accounts

Some features of the Service, including access to AI functionality, require a user account authenticated via Google Sign-In. You must provide accurate, complete, and current information. You are responsible for safeguarding your login credentials and for any activity under your account.

3. Description of Service

vide.dev provides a CLI tool and web dashboard for interacting with cloud-hosted AI services via OpenRouter, managing API keys, and viewing credit usage. AI requests are processed through OpenRouter and third-party AI providers. The Service may change or be discontinued at any time without notice.

4. Credits and Payments

The Service uses a credit-based system for access to AI features. Credits may be purchased via subscription plans or one-time purchases through our payment processor. Credits:

• Are non-transferable between accounts.
• Have no monetary value outside the Service.
• May expire after a defined period, as stated at the time of purchase.
• Are deducted upon usage of AI services.

14-Day Refund Policy

We offer a 14-day refund policy for all subscription payments and credit purchases to ensure customer satisfaction and comply with payment processor requirements:

• Eligibility: All payments are eligible for a full refund when requested within 14 days of the original payment date, regardless of credit usage.
• Full Refunds: You will receive a complete refund of your payment, even if you have used credits or AI services during the refund period.
• Process: To request a refund, contact us at norbert@nktech.dev with your order details and reason for the refund.
• Processing Time: Approved refunds will be processed within 3-5 business days to your original payment method.
• Account Access: Upon refund approval, your subscription will be terminated and access to paid features will be removed.

Exceptions: The following are not eligible for refunds:

• Refund requests made after the 14-day window from the original payment date.
• Accounts suspended or terminated for violations of these Terms.
• Payments processed through third-party services outside our direct payment system (subject to their respective refund policies).

The Company reserves the right to modify pricing and credit policies with reasonable notice. All payments are processed securely through our payment partners.

5. Acceptable Use

You agree to use the Service only in accordance with applicable laws and regulations. You may not:

• Use the Service to submit or generate unlawful, harmful, harassing, defamatory, obscene, hateful, or otherwise objectionable content.
• Use the Service for any purpose that infringes intellectual property, privacy, or other rights of any person.
• Attempt to circumvent, disable, or interfere with Service security or rate limits.
• Use the Service to distribute malware or engage in unauthorized data scraping.
• Represent AI-generated output as human-authored where doing so would be misleading.

You must also comply with the acceptable use policies of third-party AI providers (e.g., OpenRouter, OpenAI). Use of the AI functionality constitutes your agreement to be bound by their terms.

6. Intellectual Property

All rights, title, and interest in and to the Service (including but not limited to software, interfaces, and branding) are owned by the Company or its licensors.

You retain ownership of any prompts, inputs, or content you submit. To the extent permitted by law, you also own the output generated from your prompts. The Company does not claim ownership of your input or output but may use it as necessary to provide the Service.

You may use the Service and outputs for commercial purposes, provided your use complies with these Terms.

By submitting feedback or suggestions, you grant the Company a non-exclusive, worldwide, royalty-free license to use, modify, and incorporate it into the Service without obligation to you.

7. Privacy

Our Privacy Policy explains how we collect and use personal data. By using the Service, you agree to our privacy practices as described therein.

8. Disclaimers

The Service is provided "as is" and "as available" without warranty of any kind. We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

We make no guarantees regarding:

• The accuracy, completeness, or reliability of AI-generated output.
• The availability, uptime, or performance of the Service.
• The Service meeting your expectations or requirements.

Use the Service at your own risk.

9. Limitation of Liability

To the fullest extent permitted by law, the Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill.

Our total liability for any claim relating to the Service shall not exceed the amount you paid, if any, to use the Service in the 6 months preceding the claim.

Some jurisdictions do not allow limitations of liability, so these may not apply to you.

10. Indemnification

You agree to indemnify, defend, and hold harmless the Company, its affiliates, and personnel from and against any claims, liabilities, damages, and costs (including legal fees) arising from:

• Your use or misuse of the Service.
• Your violation of these Terms.
• Any content you submit to the Service.

11. Termination

We may suspend or terminate your access to the Service at any time for any reason, including breach of these Terms. Upon termination, your rights to use the Service and any remaining credits will be forfeited.

You may terminate your account at any time via the dashboard or by contacting us. Provisions that should survive termination will continue to apply, including ownership, disclaimers, and limitations of liability.

12. Governing Law and Jurisdiction

These Terms are governed by the laws of the Federal Republic of Germany, without regard to its conflict of law principles. Any disputes shall be resolved in the courts of Karlsruhe, Germany.

13. Changes to Terms

We may modify these Terms from time to time. If we make material changes, we will notify you by updating the date at the top of this page and, where appropriate, providing additional notice. Continued use of the Service after changes constitutes acceptance.
